THESE ARE THE OFFICIAL RULES OF THE PUBLIC RADIO TALENT QUEST CONTEST (“CONTEST”) AND SUPERSEDE ALL OTHER DOCUMENTS, INCLUDING ANYTHING APPEARING ON ANY PART OF THE CONTEST WEBSITE (HTTP://WWW.PUBLICRADIOQUEST.COM), OR ANY POSTING TO THE MESSAGE BOARDS/DISCUSSION FORUMS OF THE WEBSITE.
THIS CONTEST IS MADE POSSIBLE BY A GRANT FROM THE CORPORATION FOR PUBLIC BROADCASTING (“CPB”) AND IS CONDUCTED SOLELY BY The Station Resource Group/Public Radio Exchange (the "Sponsor").
1. CONTEST SUMMARY:
The Contest is a competition in which participants will compete based on their skills as the host of a public radio program. At the conclusion of the Contest, three winning Entrants will each be awarded US $10,000, cash. Three mentors will each be awarded US $6,000 to help the Entrants produce pilot radio programs, and the resulting programs will be presented to CPB, which will decide whether to fund the development of a national program hosted by a winning Entrants. THERE IS NO GUARANTEE, EXPRESSED OR IMPLIED, THAT ANY OF THE THREE WINNERS WILL RECEIVE FURTHER FUNDING TO PRODUCE A PROGRAM BEYOND THE PILOT.
The Contest will take place online at www.publicradioquest.com (the "Contest Site"). Entrants may submit audio recordings (“Pieces”) of their performance in one of three categories: “talk,” “entertainment,” or “music”). The Pieces will be rated and commented upon by the public and reviewed and voted on by a panel of Judges as described in Rules 8 and 9. The Contest begins at 12:01 AM ET on April 16, 2007 and ends with the selection of the finalists on September 24, 2007, subject to change pursuant to Rule 8.6.
The Contest will include 5 rounds, as follows:
Round: One
Description: Round One consists of an online competition in which Entrants will be invited to submit a two (2) minute audio recording and identify the Category in which they are submitting their Piece (i.e. “talk,” “entertainment,” or “music”). All submissions may be voted on and rated by the public and by a panel of expert Judges. Ten (10) semi-finalists will be selected at the end of Round One, nine (9) based on the rulings of the Judges, and one based on Public Voting, subject to review by the Judges.
Dates: April 16, 2007 to May 14, 2007
Prizes: Ten (10) Winners advancing to Round Two shall each receive $500
Round: Two
Description: The ten semi-finalists will compete in a series of audio challenges (each, a "Challenge"). The semi-finalists will submit audio recordings featuring the results of each Challenge. All submissions may be voted on and rated by the public and by a panel of expert Judges. Seven (7) semi-finalists will be selected at the end of Round Two, six (6) based on the rulings of the Judges, and one based on Public Voting, subject to review by the Judges.
Dates: June 4, 2007-July 2, 2007
Prizes: Seven (7) Winners advancing to Round Three shall each receive $1000.
Round: Three
Description: The seven (7) remaining semi-finalists will compete in further Challenges and will submit audio recordings featuring the results of each Challenge. All submissions may be voted on and rated by the public and by a panel of expert Judges. Five (5) semi-finalists will be selected at the end of Round Three, four (4) based on the rulings of the Judges, and one based on Public Voting, subject to review by the Judges.
Dates: July 12, to August 12, 2007
Prizes: Five (5) Winners advancing to Round Four shall receive $2500
Round: Four
Description: The five (5) remaining semi-finalists will compete in a final series of Challenges and will submit audio recordings featuring the results of each Challenge. All submissions may be voted on and rated by the public and by a panel of expert Judges. Three (3) semi-finalists will be selected at the end of Round Four, two (2) based on the rulings of the Judges, and one based on Public Voting, subject to review by the Judges. Three Finalists will be declared at the end of Round Four, subject to verification and compliance with the Official Rules, and advance to Round Five
Dates: August 21, 2007 to September 17, 2007
Prizes: Three (3) Finalists shall each Receive $10,000 plus $6000 for a mentor/ producer
Round: Five
Description: The three (3) Finalists will be paired with production mentors and produce a Pilot Radio Program. These pilots will be voted on by the public and submitted to (CPB).
Dates: October 1, 2007 to December 13, 2007
Prizes: Submission to CPB for possible funding consideration
2. ELIGIBILITY:
This Contest is open to legal residents of the United States who: (a) are at the time of entry 18 years of age or have reached the age of majority in their jurisdiction of residence, whichever is greater, and (b) are legally able to work in the United States. Employees and agents of Sponsor, its affiliates, subsidiaries, advertising and promotion agencies, CPB employees, any other prize Sponsor, and any entity involved in the development, production, implementation, administration or fulfillment of the Contest (all of the foregoing, together with Sponsor, collectively referred to as "Promotion Entities"), and their immediate family members and/or those living in the same household of such persons, whether related or not, are ineligible to enter the Contest.
3. HOW TO REGISTER.
3.1. TO BE AN ENTRANT:
To enter the Contest you must first register and become an Entrant, a Voter, or both (together, “Participants”). Registration is free at www.publicradioquest.com (the "Contest Site"). As part of the registration process, Participants will be required to accept and agree to be bound by these Official Rules and the Terms of Use of the site, and accept the decisions of the Judges and the Sponsor as final. Limit one (1) registration per person. Anyone who attempts to register, or in the sole discretion of Sponsor is suspected of registering, more than once, by any means, including but not limited to establishing multiple e-mail accounts or Screen Names will be disqualified.
3.2. TO BE A VOTER
Anyone wishing to vote and comment on Entrant submission, must register at the Contest Site to become a Public Voter (“Voter”). Registration is free. Voters will be required to accept and agree to be bound by these Official Rules and the Terms of Use of the site, and accept the decisions of the Judges and the Sponsor as final. Limit one (1) registration per person. Any individual who attempts to register, or in the sole discretion of Sponsor is suspected of registering, more than once, by any means, including but not limited to establishing multiple e-mail accounts or Screen Names will be disqualified.
3.2. ENTRANTS ALLOWED TO VOTE.
Entrants will be allowed to vote and comment on both their Pieces and the Pieces of others in the same manner as Voters.
4. HOW TO SUBMIT A CONTEST ENTRY:
Entrants must follow online instructions to encode and upload audio submissions. An Entrant may submit only one Piece per Round. Pieces must be uploaded no later than the dates specified above.
Pieces should showcase individual talents and creativity. All Pieces: (a) must comply with the specified length of a Piece for each round; (b) must be formatted and encoded according to the requirements set forth at the Contest Site; (c) must be in English, if there is spoken language in the Piece; (d) must not, according to the sole discretion of the Sponsor, contain indecent, obscene, disparaging, libelous or other content inappropriate for a general audience; and (e) must not, in the sole discretion of Sponsor, contain commercial content that promotes any product or service; (g) must not contain copyrighted works (other than works owned by the Entrant), unless such copyrighted works have been licensed by Entrant. Any elements appearing in a Piece, including without limitation music, audio, speech/voiceovers, stills, video, or other audiovisual materials (collectively, "Elements") must be entirely original, created and performed by the Entrant, be licensed by the Entrant, or be in the public domain. Use of any Elements or other materials that are not original, licensed, or in the public domain may result in disqualification of the Entrant, at Sponsor's sole discretion. JUDGES MAY DISQUALIFY A PIECE AND REMOVE IT FROM THE WEBSITE, AND DISQUALIFY THE ENTRANT, IF THEY, IN THEIR JUDGMENT, BELIEVE IT CONTAINS THE UNLICENSED INTELLECTUAL PROPERTY OF A THIRD PARTY.
5. CONDITIONS OF CONTEST ENTRY:
Each Entrant shall retain ownership of any Piece he/she enters into the Contest. However, as conditions of entry into the Contest, each Entrant:
5.1. REPRESENTS AND WARRANTS THAT THE ENTRANT OWNS, OR HAS A LICENSE TO USE, ALL RIGHTS TO THE PIECES HE/SHE IS SUBMITTING, INCLUDING, WITHOUT LIMITATION, THE AUDIO, VIDEO OR DIGITAL RECORDING, AND THE PERFORMANCE CONTAINED IN EACH PIECE (COLLECTIVELY, THE "CONTEST ENTRY MATERIALS");
5.2. REPRESENTS AND WARRANTS THAT THE ENTRANT IS THE INDIVIDUAL HEARD AND PICTURED IN THE RECORDING (if applicable), OR, ALTERNATIVELY, THAT THE ENTRANT HAS OBTAINED AN APPROPRIATE CONSENT AND RELEASE FROM EACH PERSON WHO APPEARS IN THE CONTEST ENTRY MATERIALS, AND CAN MAKE SUCH CONSENTS AND RELEASES AVAILABLE TO SPONSORS UPON REQUEST;
5.3. REPRESENTS AND WARRANTS THAT: (a) HIS/HER CONTEST ENTRY MATERIALS ARE ORIGINAL AND HAVE BEEN LEGALLY OBTAINED AND CREATED, AND DO NOT INFRINGE THE INTELLECTUAL PROPERTY RIGHTS OR ANY OTHER LEGAL RIGHTS OF ANY THIRD PARTY;
5.4. Entrant grants to Promotion Entities and their affiliates, legal representatives, assigns, agents and licensees, the worldwide, royalty-free, non-exclusive, sublicensable, unconditional, perpetual and transferable right and license to copyright, reproduce, encode, store, modify, copy, transmit, publish, post, broadcast, display, publicly perform, adapt, excerpt, exhibit and/or otherwise use or reuse (without limitation as to when or to the number of times used), the Entrant's name, address, image, voice, likeness, statements, biographical material and Contest Entry Materials, including, but not limited to, the audio, video or digital recording and performances contained in any of the above items, as well as any additional photographic images, video images, portraits, interviews or other materials relating to the Entrant and arising out of his/her participation in this Contest (with or without using the Entrant's name) (collectively, the "Additional Materials") (in each case, as submitted or as edited/modified in any way, whether by the Promotion Entities, their licensees, or assigns, in the Promotion Entities' sole discretion) in any media throughout the world for any purpose, without limitation, and without additional review, compensation, or approval from the Entrant or any other party.
5.5. Entrant Participant acknowledges that, and grants all licenses necessary to permit: (i) the public to have access to the Contest Entry Materials through the Contest Site (ii) Voters to rate, review, comment on and tag the Contest Entry Materials; (iii) the Sponsor to embed a media player with the Contest Entry Materials on Participant web sites, (iv) Participants to send and distribute the Contest Entry Materials via e-mail or instant messenger on the Contest Site; (v) The Sponsor to access the Contest Entry Materials via Sponsor's web service APIs or via RSS or any similar XML or related feeds; and (vi) the Sponsor to use, reproduce, distribute, remix, prepare derivative works of and compilations, display and perform the Contest Entry Materials as permitted through the functionality of the publicradioquest.com service and under the Public Radio Talent Quest Terms of Service (http://publicradioquest.com/node/21)
5.6. To the extent Entrant has any other intellectual property right in its Contest Entry Materials or Additional Materials not otherwise explicitly covered herein, it hereby grants the Promotion Entities and their affiliates, legal representatives, assigns, agents and licensees, the worldwide, royalty-free, non-exclusive, sublicensable, unconditional, perpetual and transferable right and license to such intellectual property to be used in all manners consistent with these Rules.
5.7. Entrant grants (a) Sponsor access to and the right to create or have created literary, film, tape and/or other materials, ideas and concepts which may be similar or identical to the Contest Entry Materials in theme, idea, plot, format, characters and/or other respects; (b) the Entrant will not be entitled to any compensation or other consideration because of the use by Sponsor of any such similar or identical material, ideas and/or concepts; and (c) Sponsor's use of material containing elements similar to or identical with those contained in the Contest Entry Materials or any Piece shall not obligate Sponsor to negotiate with nor entitle Participant to any compensation or other claim.
5.8. Entrant agrees to indemnify and hold the Promotion Entities and their respective affiliates, officers, directors, agents, co-branders or other partners, and any of their employees (collectively, the "Promotion Indemnitees"), harmless from any and all claims, damages, expenses, costs (including reasonable attorneys' fees) and liabilities (including settlements), brought or asserted by any third party against any of the Promotion Indemnitees arising out of or in connection with (a) any Contest Entry Materials or Additional Materials (including, but not limited to, any and all claims of third parties, whether or not groundless, based on the submission of such other material);
(b) any breach of any warranty, agreement or representation contained in the Official Rules or terms of service or in any documentation submitted by Participant; (c) the Entrant's conduct during and in connection with this Contest, including but not limited to trademark, copyright, or other intellectual property rights, right of publicity, right of privacy or defamation; or (d) the acceptance of any prize.
6. CONDITIONS ON VOTING
6.1. By voting, rating, or commenting on Entries (“Voting”), Voter irrevocably grants to Promotion Entities and their affiliates, legal representatives, assigns, agents and licensees, the worldwide, royalty-free, non-exclusive, sublicensable, unconditional, perpetual and transferable right and license to copyright (only as applicable), reproduce, encode, store, modify, copy, transmit, publish, post, broadcast, display, publicly perform, adapt, exhibit and/or otherwise use or reuse (without limitation as to when or to the number of times used), the Voter’s votes, ratings and comments arising out of his/her participation in this Contest in any media throughout the world for any purpose, without limitation, and without additional review, compensation, or approval from the Voter or any other party.
6.2. To the extent Voter has any other intellectual property right in its Contest Entry Materials or Additional Materials not otherwise explicitly covered herein, it hereby grants the Promotion Entities and their affiliates, legal representatives, assigns, agents and licensees, the worldwide, royalty-free, non-exclusive, sublicensable, unconditional, perpetual and transferable right and license to such intellectual property to be used in all manners consistent with these Rules.
6.3. Voter agrees to indemnify and hold the Promotion Entities and their respective affiliates, officers, directors, agents, co-branders or other partners, and any of their employees (collectively, the "Promotion Indemnitees"), harmless from any and all claims, damages, expenses, costs (including reasonable attorneys' fees) and liabilities (including settlements), brought or asserted by any third party against any of the Promotion Indemnitees arising out of or in connection with (a) any Voting (including, but not limited to, any and all claims of third parties, whether or not groundless, based on the submission of such other material); (b) any breach by Voter of any warranty, agreement or representation contained in the Official Rules or terms of service or in any documentation submitted by Participant; (c) the Entrant's conduct during and in connection with this Contest, including but not limited to trademark, copyright, or other intellectual property rights, right of publicity, right of privacy or defamation; or (d) the acceptance of any prize.
7. SPONSOR'S RIGHT TO DISQUALIFY:
Sponsor reserves the right, in its sole discretion, at any time during the Contest, to disqualify and remove any Piece that it believes contains any inappropriate content, infringes the rights of any third party, or otherwise does not meet other requirements of these Official Rules, and thereby disqualify Entrant. The decisions of the Sponsor on this and all other matters relating to the Contest are final and binding.
8. SEMI-FINALIST SELECTION PROCESS:
8.1. Public Voting
Eligible Pieces will be displayed on the Contest Site starting April 16, 2007. Between April 16, 2007 and September 23, 2007 at 11:59 PM ET, (the "Public Voting Period"). Registered Voters will have the opportunity to view all Eligible Pieces, and have the opportunity to vote for each Piece once and only once. Voters will be asked to rate Pieces on a 1 to 5 star rating scale with 1 star being the lowest score and 5 stars being the highest score, based on the Judging Criteria (defined below) . Voters may also comment on the Pieces they rate.
8.2 Judges Evaluation.
8.2.1. Preliminary Review. The Pieces in Round One will be rated by a Preliminary Panel consisting of Judges, editors and staff selected by the Sponsor and/or the Promotion Entities (the "Preliminary Panel"), who will select up to 200 Entrants, based on the Judging Criteria (defined below) and public voting and comments. This list will not be announced. Sponsor reserves the right to select fewer than 200 Entrants in the event there is an insufficient number of eligible or appropriate entries in the Contest. Entrants will be judged on these equally weighted criteria: creativity, entertainment ability, and audience appeal (the "Judging Criteria").
8.2.2. Judges Review. The Judges will then judge the Entrants selected by the Preliminary Panel according to the following Judging Criteria:
a) Creativity and Originality of Piece;
b) Whether the Piece indicates that the Entrant would make a good public radio host, including, but not limited to, whether the Piece shows that the Entrant is engaging, intelligent, curious, authentic, honest, interesting, knowledgeable,;
c) Whether the Piece provides evidence that the Entrant’s approach would lead to a successful public radio show; and
d) Public Voting. The Judges will consider the results of the public voting as an additional factor in applying the foregoing criteria, but will not be bound by the results of the public voting.
8.3 Round One Results
8.3.1. At the end of Round One, the Judges will name 9 semi-finalists, who will advance to Round Two.
8.3.2. At the end of Round One, one Entrant who is not already included in the 9 semi-finalists selected by the Judges will be deemed the “People’s Choice” and move forward to Round Two. The People’s Choice will be the Entrant with an Eligible Piece that receives the highest score through Public Voting. The highest score is determined through a weighted average of votes on the site. Voters can only rate each Piece once. In the event of a tie, the tied entries will be re-judged by a different panel of Judges selected by the Sponsor, using the same Judging Criteria.
8.3.3. The Judges will then select up to fifteen (15) alternate semi-finalists ("Alternates"), in rank order, from among the remaining eligible Pieces as scored by the Voters and Judges.
8.3.4. Advancement to Round Two. Between approximately June 3 and June 30, 2007, the ten selected semi-finalists and up to 15 alternates will be contacted by telephone and/or email to arrange a personal interview and pre-screening with the Sponsor (the "Pre-Screening"). Each potential semi-finalist will be required to execute and return an Affidavit of Eligibility and Liability/Publicity Release (collectively, an "Affidavit and Release"), together with a non-disclosure agreement ("NDA") and other pre-employment documentation or screening that may be required by Sponsor in connection with its normal pre-employment screening procedures. Any potential semi-finalist who cannot be contacted, does not return correspondence from the Sponsor within 24 hours following attempted notification, or fails to comply with the Sponsor's verification process and/or eligibility requirements for the pre-screening, may be disqualified. Similarly, any semi-finalist who does not complete and return the Affidavit and Release to Sponsor within 48 hours of Sponsor’s delivery of those documents to the potential semi-finalist, may be disqualified. In the event of one or more disqualifications, alternate potential semi-finalist may be selected, in rank order, from among the remaining alternates, subject to the same eligibility and verification requirements described in these Official Rules. Potential semi-finalists or alternates who are disqualified for any reason will not be entitled to any form of compensation, and any and all rights to further participation in this competition will be forfeited. As with the initial judging criteria, the Judges reserve the right to select fewer than ten semi-finalists in the event that fewer than ten potential semi-finalists are deemed to meet the Judging Criteria.
8.4. Subsequent Round Judging. After Round One, judging will be done by the Judges, pursuant to the Judging Criteria. Subsequent round Challenges may entail a variety of activities, some of which may require Entrants to travel short distances at their own expense (not to exceed 20% of the preceding round cash prize), such as visiting the nearest local public radio station. Entrants are required to submit Pieces according to the instructions which accompany each Challenge, as conveyed to the Entrant, either through the Contest Site or e-mail.
8.5. Advancement to Additional Rounds. After the end of each round (including Round One), prizes will be awarded only after the Entrant has submitted his/her Piece for the subsequent round. For example, in order to qualify to receive the Round One award of $500, a semi-finalist must submit an Eligible Piece for Round Two. The failure of a semi-finalist to submit an Eligible Piece for succeeding rounds will result in disqualification. No substitute semi-finalist may submit an Eligible Piece in a subsequent round in the event that a qualified semi-finalist fails to submit an Eligible Piece.
8.6. Sponsor reserves the right to revise the timeline for submission of entries,. if, in the sole discretion of the Sponsor, the established timeline for entries fails to secure sufficient Eligible Pieces. Neither the Sponsor or Judges will extend any deadline for the submission of Pieces based solely on the request of Entrants.
9. FINALIST SELECTION
9.1. The three (3) Finalists will each be awarded $10,000 and be paired with a production mentor to produce a Pilot Radio Program. The mentors, to be chosen by the Sponsor (and who may include one of the Judges or others affiliated with the Sponsor), shall be awarded $6,000, to assist each paired winner in producing a Pilot Radio Program.
9.2. The three (3) Pilot Radio Programs will be voted on by the public and submitted to the Corporation for Public Broadcasting (CPB) for further possible funding consideration.
9.3. In accepting the position as a final winner, the Entrant agrees that he/she will grant the Sponsor the right of first negotiation for the production and/or distribution rights of any future public radio programming that results directly or indirectly from the Pilot Radio Program.
10. GENERAL RULES:
The Contest is governed by and subject to the laws of the United States. All federal, state and local laws and regulations apply. The Contest is void where prohibited by law. All finalists will receive an IRS 1099 statement for the value of their stipends. By participating in the Contest and/or accepting any prize, participants authorize the Sponsor and its advertising and promotion agencies to use their name, likenesses, Pieces and any other material submitted in connection with the Contest for purposes of advertising, publicity and promotion purposes, without further compensation to Entrant. Sponsor is not responsible for any typographical or other errors in the printing of the Contest Rules, administration of the Contest or the announcement of the prizes, or for lost, late, misdirected, damaged, incomplete or illegal entries.
The Sponsor reserves the right, at its sole discretion, to disqualify any Contest Entry or the Vote of any individual found to be (a) tampering or attempting to tamper with the entry process or the operation of the Contest; (b) violating the Official Rules; (c) violating the terms of service, conditions of use and/or general rules or guidelines of any the Sponsor’s property or service, or (d) acting in an unsportsmanlike or disruptive manner, or with intent to annoy, abuse, threaten or harass any other person. The Public Radio Talent Quest also reserves the right to disqualify any entry which, in the Sponsor’s sole opinion, is deemed to be offensive, libelous, slanderous, inflammatory, or otherwise inappropriate in any way for this Contest. CAUTION: ANY ATTEMPT TO DAMAGE THE CONTEST SITE OR UNDERMINE THE LEGITIMATE OPERATION OF THE CONTEST MAY BE A VIOLATION OF CRIMINAL AND CIVIL LAWS. SHOULD SUCH AN ATTEMPT BE MADE, THE SPONSOR RESERVES THE RIGHT TO SEEK DAMAGES FROM ANY SUCH PERSON TO THE FULL EXTENT OF THE LAW.
11. LIMITATIONS OF LIABILITY:
The Promotion Entities assume no responsibility for any computer, online, telephone transmission or technical malfunctions that may occur during the Contest (including, without limitation, the voting phase of the Contest), or for theft, destruction or unauthorized access to, or alteration of, Pieces or Votes. Promotion Entities are not responsible for any incorrect or inaccurate information, whether caused by website users, Participants or any of the equipment or programming associated with or utilized in the Contest; for any technical or human error which may occur in the processing of submissions or votes in the Contest. Sponsor assumes no responsibility for any error, omission, interruption, deletion, defect, delay in operation or transmission, failures or technical malfunction of any telephone network or lines, computer online systems, servers, providers, computer equipment, software, email, players or browsers, whether on account of technical problems, traffic congestion on the Internet or at any website, or any combination of the foregoing (including but not limited to any such problems which may result in the inability to access the Contest Site or to submit Entry Materials or Votes in connection with the Contest). Sponsor is not responsible for any injury or damage to participants or to any computer related to or resulting from participating or downloading materials in this Contest. If the Sponsor is unable to conduct the Contest as planned, including infection by computer virus, bugs, tampering, unauthorized intervention, fraud, technical failures, or any other causes which corrupt or affect the administration, security, fairness, integrity or proper conduct of this Contest, Sponsor reserves the right, at its sole discretion, to cancel, terminate, modify or suspend the Contest and select winners from among that portion of the Contest that has not been compromised, if any.
12. DISPUTES/GOVERNING LAW:
As a condition of participating in this Contest, Participant agrees to attempt in good faith to resolve any and all disputes, claims and causes of action arising out of or connected with this Contest, or any prize awarded.
IN THE EVENT THAT DISPUTES RELATED TO THE CONTEST CANNOT BE RESOLVED INFORMALLY, PARTICIPANTS AGREE THAT THE SOLE AND EXCLUSIVE FORUM FOR RESOLVING ANY CONTROVERSY OR CLAIM ARISING OUT OF OR RELATING TO THE CONTEST SHALL BE BINDING ARBITRATION, UNDER THE AMERICAN ARBITRATION ASSOCIATION ("AAA") COMMERCIAL ARBITRATION RULES, THEN IN EFFECT. PARTICIPANTS ALSO AGREE THAT THE AAA OPTIONAL RULES FOR EMERGENCY MEASURES OF PROTECTION SHALL ALSO APPLY TO THE PROCEEDINGS. JUDGMENT ON THE AWARD RENDERED BY THE ARBITRATORS MAY BE ENTERED IN ANY COURT HAVING JURISDICTION THEREOF. IN THE EVENT THAT THIS PARAGRAPH IS HELD INVALID OR UNENFORCEABLE, THE REMAINING PORTIONS OF THIS SECTION SHALL REMAIN IN FULL FORCE AND EFFECT.
THE LOCATION OF THE ARBITRATION SHALL BE MONTOMERY COUNTY, MARYLAND, AND PARTICIPANT HEREBY EXPRESSLY AGREES TO ARBITRATE THERE, AND WAIVE AND AGREE NOT TO RAISE ANY AND ALL OBJECTIONS BASED ON PERSONAL JURISDICTION, VENUE, AND/OR INCONVENIENCE OF SUCH FORUM. IN THE EVENT THAT THIS PARAGRAPH IS HELD INVALID OR UNENFORCEABLE, THE REMAINING PORTIONS OF THIS SECTION SHALL REMAIN IN FULL FORCE AND EFFECT.
Any such controversy or claim shall be arbitrated on an individual basis, and shall not be consolidated in any arbitration with any claim or controversy of any other party. The arbitration shall be conducted in the State of Maryland, County of Montgomery, and judgment on the arbitration award may be entered into any court having jurisdiction thereof.
In the event of a dispute as to the identity of a winner based on email address, the winning entry will be declared made by the Authorized Account Holder of the email address submitted at time of entry. For purposes of these Official Rules, "Authorized Account Holder" is defined as the natural person who is assigned to an email addresses by an Internet access provider, online service provider or other organization (e.g., business, educational, institution, etc.) that is responsible for assigning email addresses for the domain associated with the submitted email address.
